Client Terms of Service

These terms apply to aerial photography and video services provided by Triangle Aerial Media. By booking a shoot, approving a quote, paying an invoice, downloading files, or using delivered media, the client agrees to these terms.

1. Services

Triangle Aerial Media provides aerial photo and video services for real estate, land, construction, business exteriors, and related property marketing.

The exact services, location, package, price, and deliverables will be listed in the quote, invoice, message thread, or booking confirmation.

2. Booking and Scheduling

Shoots are scheduled based on weather, lighting, property access, airspace, safety, and availability.

A shoot may be delayed, rescheduled, shortened, or canceled if conditions are unsafe, restricted, or unsuitable for flight. This includes weather, wind, rain, low visibility, airspace limits, nearby aircraft activity, people or vehicles in the area, animals, obstacles, or lack of legal property access.

3. Booking Hold

A booking hold is required to confirm a shoot. The booking hold is credited toward the final invoice total.

The shoot is not considered confirmed until the required booking hold has been paid.

Starter Aerial Photos require a $50 booking hold.

Standard Property Photos require a $75 booking hold.

Large Property Photos require a $100 booking hold.

If a Video Clip Pack is added to a photo package, no separate booking hold is required unless stated otherwise.

Photo packages with video add-ons may require a $100 booking hold.

Custom Video Work and other custom quoted projects may require a larger booking hold, usually 30% of the quoted total or a $150 minimum, depending on the project.

If a shoot is delayed or rescheduled because of weather, airspace, safety, or other conditions outside the client’s control, the booking hold will be applied to the rescheduled shoot at no extra charge.

If the client requests to reschedule within 24 hours of the scheduled shoot time for a reason not related to weather, airspace, safety, or access restrictions outside their control, a $50 rescheduling fee may apply.

If the client cancels within 24 hours of the scheduled shoot time, the booking hold may be kept as a cancellation fee.

If the client does not provide access, provides incorrect location information, lacks permission for the shoot, or causes the shoot to be delayed or canceled after arrival, the booking hold may be kept as a cancellation or scheduling fee and additional fees may apply.

If Triangle Aerial Media must cancel for reasons outside the client’s control and the shoot cannot be rescheduled, any paid booking hold may be refunded.

4. Payment and File Delivery

The remaining balance is due before final files are delivered.

Triangle Aerial Media may withhold final high-resolution photos, video clips, or other deliverables until the invoice is paid in full.

Watermarked previews or low-resolution proofs may be provided before final payment at Triangle Aerial Media’s discretion.

Additional work, extra edited photos, video add-ons, rush delivery, travel, revisions, additional locations, or work outside the original quote may require additional payment before delivery.

5. Drone Safety and Flight Limits

All drone flights are subject to applicable laws, airspace rules, safety limits, and pilot judgment.

Triangle Aerial Media may refuse or stop any flight that appears unsafe, illegal, restricted, or unreasonable. The client may request certain angles or coverage, but the final flight decision is made by the pilot or remote pilot in command.

If a location requires special airspace authorization, extra planning, property access, or permission from a property owner, the shoot may require additional time, a changed plan, or a custom quote.

6. Property Access and Client Permission

The client is responsible for confirming that they have permission for the requested shoot location and that the property can be accessed safely and legally.

The client must notify Triangle Aerial Media before the shoot about gates, access codes, restricted areas, animals, tenants, active construction, privacy concerns, or anything else that could affect the shoot.

7. Deliverables

Delivered files may include edited photos, video clip packs, or custom video work depending on the package purchased.

Triangle Aerial Media selects the best images and clips from the shoot. Not every captured photo or video clip will be delivered.

Basic editing may include color correction, horizon straightening, cropping, exposure adjustments, and file export. Advanced editing, object removal, boundary graphics, text graphics, music, long-form editing, or custom revisions are not included unless agreed to separately.

8. Turnaround Time

Estimated delivery time will be provided when the shoot is booked or after the shoot is completed.

Delivery times may vary based on weather delays, scheduling, project size, editing needs, file size, revisions, and other workload.

Rush delivery may be available for an additional fee depending on schedule.

9. Cancellations and Rescheduling

Weather-related, airspace-related, safety-related, or pilot-required rescheduling does not count as a client cancellation and does not create a rescheduling fee.

Client-requested rescheduling within 24 hours of the scheduled shoot time may require a $50 rescheduling fee.

If the client cancels within 24 hours of the scheduled shoot time, the booking hold may be kept as a cancellation fee.

If the client does not provide access, provides incorrect location information, lacks permission for the shoot, or causes the shoot to be delayed or canceled after arrival, the booking hold may be kept as a cancellation or scheduling fee and additional fees may apply.

If Triangle Aerial Media must cancel for reasons outside the client’s control and the shoot cannot be rescheduled, any paid booking hold may be refunded.

10. Copyright Ownership

Triangle Aerial Media retains copyright ownership of all photos, videos, clips, and other media captured or created during the shoot unless a separate written copyright transfer is signed.

Buying a shoot does not transfer copyright ownership. The client receives a license to use the delivered files as described in these terms.

11. Client Usage License

After payment is received, the client may use the delivered files for normal business, listing, and online marketing purposes. This includes real estate listings, MLS use where allowed, websites, social media, email marketing, online ads, presentations, and general property promotion.

The client may share delivered files with their real estate team, broker, builder, contractor, designer, marketing team, or business staff for the same project.

The client may not sell, resell, sublicense, transfer, or give the files to unrelated third parties for separate use without written permission from Triangle Aerial Media.

12. Credit

Photo credit is appreciated when practical, especially on social media, but it is not required for normal listing, website, or marketing use.

13. Portfolio Use

Triangle Aerial Media may use delivered work for portfolio, website, social media, sample galleries, advertising, and business promotion unless the client requests otherwise before the shoot.

If a project is private, sensitive, unreleased, or confidential, the client must state that before booking or before the shoot.

14. Raw Files

Raw files, unedited files, rejected images, original drone files, project files, and editing timelines are not included unless agreed to separately in writing.

15. Revisions

Reasonable corrections may be requested if there is a delivery issue, export issue, or clear editing mistake.

Creative changes, extra editing, additional exports, new crops, object removal, boundary graphics, music changes, text graphics, or other edits outside the original scope may require an additional fee.

16. No Survey, Inspection, or Measurement Guarantee

Aerial photos and videos are for visual marketing and general property context only.

They are not a replacement for a survey, inspection, appraisal, engineering report, roof inspection, legal boundary determination, or official measurement.

Triangle Aerial Media does not guarantee boundary accuracy, measurements, property lines, structural condition, roof condition, code compliance, or site safety.

17. Weather, Airspace, and Safety Disclaimer

Drone work depends on safe weather, legal airspace, visibility, property access, and pilot judgment.

Triangle Aerial Media is not responsible for delays, changed angles, reduced coverage, or canceled flights caused by weather, airspace restrictions, safety concerns, lack of access, or conditions outside its control.

18. Client Responsibility for Final Use

The client is responsible for making sure their use of delivered files follows MLS rules, brokerage rules, platform rules, advertising laws, privacy requirements, and any property owner requirements.

19. Limitation of Liability

Triangle Aerial Media’s total liability for any claim related to a shoot is limited to the amount paid by the client for that shoot.

Triangle Aerial Media is not responsible for indirect losses, lost sales, lost listings, lost business, platform issues, MLS issues, or third-party use of delivered files.

20. Changes to These Terms

Triangle Aerial Media may update these terms from time to time. The terms in effect at the time of booking apply to that shoot unless otherwise agreed in writing.

21. Agreement

By booking a shoot, approving a quote, paying an invoice, downloading files, or using delivered media, the client agrees to these terms.
